What Happens If You Lose?

Our Solicitors will not charge any fee for professional services which they have carried out in relation to your claim for compensation if you are unsuccessful. You would, however, remain liable for any outlays reasonably incurred on your behalf, such as the cost of medical reports, police accident reports etc.

What Happens If You Win?

If a settlement is successfully negotiated, without the need for court proceedings, we would expect our fees and outlays to be met by the other party's insurers. In the unlikely event that the fees and outlays are not met by the insurers, or there is a shortfall, our Solicitors would be entitled to claim a reasonable fee for work carried out and you would remain responsible for any outlays.

What Happens If The Agreement Ends Before Negotiations Are Completed?

If either our Solicitors or you decide to terminate the agreement before negotiations are complete, you will be liable to pay a reasonable fee plus VAT for the work carried out and remain responsible for any outlays.

Outlays

ln proving or negotiating your claim it may be necessary for outlays such as a police report or a medical report to be obtained. We will not instruct any outlays without your prior knowledge. In most cases we are able to obtain the insurers agreement to meet any outlays incurred.

What Happens If Negotiations Have Failed and Court Proceedings Are Required?

If negotiations with the insurers have been unsuccessful we may recommend that you consider raising a court action against the party you hold responsible. Court proceedings can be risky and costly and in the event of court proceedings being required our No Win, No Fee agreement would come to an end. Our Solicitors will be happy to advise you on the various ways in which a court action can be funded.

Other Forms of Funding

ln many cases, Legal Aid or other forms of funding such as legal expenses, may be available to pay for outlays such as medical reports and police accident reports etc. Our solicitors would be happy to discuss this matter further with you.
